Schedules of condition

Commercial leases are a complicated area of law, as each lease will not be the same. Statutes describe the approach necessary to ensure properties are maintained in accordance with the covenants of the lease and where there is a breach, the correct procedures for the breach to be rectified.

From the lessor's point of view a Schedule of Condition is useful to ensure that a lessee has complied with the lease covenants.

From the lessee's point of view a Schedule of Condition is necessary to ensure that the lessor does not insist on the lessee bringing the property up to a higher standard than initially existed.
